Dear All,

Just thought that i would update you with my situation.

I attended the Greivance Hearing yesterday - It has been found that Harrassment and Bullying has taken place within the workplace and colleagues, although no further action is going to be taken, so therefore my employer states that this can carry on, I now have to go through the Appeals procedure, of which I am going to do, I am so angry and annoyed, how can a big company allow this, so nothing goes against their files even.

Sorry to hear this Michelle - it sounds very unfair to have it acknowledged that these actions took place without further consequence. Have you had any reassurances tat these things willnot recurr? I'm sorry that you are having to go through the Appeals proceedure as i can imagine it is very stressful. Just wanted to say "thinking of you" - let us know how you get on XX Ailsa

You might need to get Bob in on this , but the company should have a duty to protect you from this and take action as appropriate .
They might have set themselves up by admitting there was a problem but not doing anything about it ..but again i am not an employment specialist ..
Definitely appeal the decision not to do anything as if anything happens further down the line , then you have it on record that you have done everything in your power to resolve the issue .

Hi Rich,

I have today spoken to the Union Branch with regards to submitting a claim to the solicitors but not sure what will happen about this they have said that they will pass on my details - How do I get in touch with Bob??

Hi Michelle

I would suggest you phone the NRAS helpline and ask them to pass on your details to Bob. He is an NRAS volunteer and is always happy to try to help with employment issues.

I don't know if this will help because I am not 100% certain of all the details but I have just seen what you said about Harassment and Bullying taking place within the work place.

We use to run a small business and we employed people. I attended a seminar put on by our solicitor who had started dealing with Employment Law. He had a lady talking to us about HR and how the law stood.

They told us that even if someone handed in their notice we had to do an 'Exit Interview' ie to find out why they were leaving because we may, even though they had left voluntarily end up having to go to an unfair dismissal tribunal.

The following example was said.......

Jane can't stand being bullied by John anymore, so she puts in her notice and leaves.

A few weeks later Jane is in town and meets Sue. Sue tells Jane that she has put in her notice and left because she can't take any more bullying from John.

They both then realise that John is a bully and nothings been done about it...........

They both can put in a claim for unfair dismisal.........even though they weren't sacked........An exit interview should of been done and they should of been asked why they were leaving and this problem would of come to light and something should of been done about it.

Now, I did say at the time that this was scare tactics from the solicitor to frighten us having to ask him for advice about employment issues........but there must be some truth in what he said.

So, it really is your employers duty to make certain that you are working in a 'happy environment'.

Hope you don't think that I have been waffling on and this doesn't apply in your situation.
